Changement dans la Loi / Change into the Law

Bonjour Lecteur!

Il y a grosso modo un an et demi j'ai publié un article truffé de liens vers des textes de lois belges (pour rappel c'est ici: http://gettingoutofthecloset.over-blog.com/2015/04/trolls-et-legendes-2015-les-points-negatifs.html ),il était d'actualité lors de sa publication mais avec les attentats il y a eu de grosses modifications et vu que je déteste dire des âneries je fais un point sur ces changements!

1. Le port d'armes de catégorie 6

Les armes dites de catégorie 6 sont les armes métalliques non aiguisées que beaucoup de médievistes/cosplayeurs/jouteurs pro ou non transportent avec eux lors des fêtes médiévales, des démonstrations, des évènement med' fan et j'en passe.

Ces armes (non-létales) ne sont pas interdites vu que la catégorie dans laquelle elles entre justifie leur présence et leur utilisation mais, si vous comptez vous équiper d'un de ces jolis joujous il vous faudra prouver par A + B auprès de n'importe quel fonctionnaire de police que:

- Il s'agit bien d'une arme de catégorie 6 (je vous conseille d'imprimer une documentation trouvée sur internet concernant ce type d'arme, juste au cas où le fonctionnaire de police ne connaîtrait pas cette loi et ce qu'elle englobe)

- Vous avez bel et bien une raison de l'avoir avec vous au moment du contrôle (encore une fois, un flyer concernant l'event où vous vous rendez, l'impression du mail d'invitation à une joute,... etc. peut servir de preuve et vous éviter au mieux une confiscation de l'arme au pire des poursuites judiciaires)

Le but étant d'éviter qu'un attentat se fasse à l'aide d'une épée médiévale... Les chances sont extrêmement minces mais on ne sait jamais!

2. La fouille des sacs

C'était un gros point de grogne quand j'ai écrit l'article il y a un an et demi et bien maintenant ça a changé!

Tout vigile appartenant à une société de gardiennage (pas un civil engagé comme bénévole repérable à sa casquette et son t-shirt souvent d'un goût trèèèès discutable, un vrai vigile) peut demander l'ouverture des sacs en vue de vérifier leur contenu.

Je précise bien DEMANDER L'OUVERTURE DU SAC et non pas ouvrir le sac!

Le but est d'empêcher l'entrée de tout objet pouvant s'avérer dangereux et de toutes armes dissimulées ou non. Il n'est toujours pas permis de jeter ou d'exiger que soit jeté nourriture/boisson/divers. Il est question de sécurité des personnes et non pas de despotisme!

(La tartine de Kiri n'étant toujours pas une arme aucune loi ne l'empêche d'entrer)

Attention! Cette nouvelle loi ne s'applique que lorsque le pays est en alerte de niveau 3 ou plus!

Actuellement nous sommes en niveau 3 et ce n'est pas prêt de changer!

Donc attention, bien consulter le baromètre d'alerte attentat du Ministère de l'Intérieur au matin du jour où vous allez sur un évènement! Selon qu'on se trouve au niveau 1 ou 2 l'ancienne loi s'applique et à mois que vous ouvrez votre sac sans y être invité, juste par pure bonne foi nul ne peut vous contraindre à l'ouvrir (pour rappel si c'est un officier de police vous devez obtempérer à ses demandes); si au contraire il s'agit d'un niveau  3 ou plus lorsque vous êtes invité à ouvrir votre sac par un vigile ou tout représentant officiel des forces de l'ordre vous DEVEZ obtempérer! La nuance est importante!

Je pense avoir abordé les deux points qui ont le plus changé et j'ai essayé d'éviter l'écueil que représentent les textes de loi pour la majorité d'entre vous (c'est fortement rébarbatif j'en convient).

C'est bête mais j'ai réalisé hier en allant au cinéma pour aller voir Rogue One (que j'ai beaucoup apprécié) que les changements évoqués ci-dessus sont devenus bel et bien réels. J'ai donc gentiment ouvert mon sac pour permettre au garde de vérifier que je n'étais armée d'aucune arme létale, le tout avant d'accéder au hall du cinéma.

!!! Warning! Warning! This article is entirely boring but if you come in Belgium now (after the attacks) you must know that things has changed!!!

One year and a half ago I published an article full of links to texts of Belgian laws (reminder it is here: http://gettingoutofthecloset.over-blog.com/2015/04/trolls- And-legendes-2015-the-points-negatives.html ), since then Belgium was attacked by terrorrist and  big modifications on some points of the law has been made !

1. The wearing of category 6 weapons

The category 6 weapons are the non-sharpened metallic weapons that many  medievalists / cosplayers / jousters carries with them during medieval festivals, demonstrations, med 'fan events and so on.

These (non-lethal) weapons are not prohibited because the category in which they enters justifies their presence and use but if you plan to equip yourself with one of these pretty toys you will have to prove by A + B why you have it to any police officer that:

- It is indeed a category 6 weapon (I advise you to print a document found on the Internet concerning this type of weapon, just in case the police officer does not know this law and what it Encompasses)

- You have a reason to have it with you at the time of the check (again, a flyer concerning the event where you go, the impression of the mail of invitation to a game, ... etc Can serve as proof and you can avoid a confiscation of the weapon at the worst of the prosecution)

The aim is to avoid an attack using a medieval sword ... The chances are extremely thin but you never know!

2. The search into the bags

It was a big grumbling point when I wrote the article a year and a half ago and now it has changed!

Any vigil belonging to a guarding company (not a civilian hired as a volunteer who can be spotted in his cap and his t-shirt often very questionable, a real vigil) can ask for the opening of the bags in order to check their contents.

He can ask YOU to open the bag and he cannot open the bag himself!

The aim is to prevent the entry of any dangerous object and any weapons concealed or not concealed. It is still not allowed to throw or require to thrown food / drink / anything else but no weapon or dangerous substance. It is about safety of people and not about despotism!

(Kiri's toast is still not a weapon, no law prevents it from entering)

Warning! This new law applies only when the country is on alert level 3 or higher!

Currently we are in level 3 and it is not ready to change!

So be careful, consult the barometer alert of bombing of the Ministry of Interior on the morning of the day you go on an event! Depending on if you are at level 1 or 2 the old law applies and if you dont open want to open your bag if a vigil ask you it's your right (if it is a police officer you must open); If on the contrary it is a level 3 or more when you are invited to open your bag by a vigil or any official representative of the forces of order you MUST obey! The nuance is important!

I think I have touched on the two points that have changed the most, and I have tried to avoid the pitfalls of the law for the majority of you.

It is stupid but I realized yesterday by going to the cinema to go see Rogue One (which I greatly appreciated) that the changes mentioned above have become real for us. So I nicely opened my bag to allow the guard to check that I was not armed with any lethal weapon, all before reaching the cinema hall.
